Terms of Use

These terms are an agreement between you and Jeff Schoellerman, an individual doing business as eBikeTrader ("we", "us"), covering the website at ebiketrader.net and the eBikeTrader iOS app (together, the "Service"). By creating an account or using the Service, you agree to them. If you do not agree, do not use the Service.
You must be 18
The Service is only for people 18 years of age or older. By using it you confirm that you are at least 18 and legally able to enter into this agreement.
What eBikeTrader is, and is not
eBikeTrader is a venue where people list used electric bikes and contact each other. That is all it is. We are not a party to any transaction, and we are not a broker, agent, dealer, auctioneer, escrow service, shipper, or payment processor.
We do not handle money. No payment passes through the Service. Any price, payment method, inspection, meeting, handover, warranty, or refund is arranged entirely between you and the other person, at your own risk.
We do not verify users, and we do not run background checks. We do not inspect, test, or authenticate any bike, and we do not confirm that a seller owns what they are listing or that a listing is accurate.
Your account
Keep your login credentials secure and do not share your account. Use accurate information, and keep it current. You are responsible for everything done through your account. Tell us promptly if you believe someone else has access to it. You may delete your account at any time from within the app or the website.
What you list
By posting a listing, you confirm that:
- You own the bike, or are authorized to sell it.
- It is not stolen, and is not subject to a lien, loan, or other claim you have not disclosed.
- Your description, photos, and price are accurate and not misleading, and the photos are of the actual item.
- Selling it is legal where you are, and it is not subject to a safety recall you have not disclosed.
- You own the rights to the photos and text you upload, or have permission to use them.
Things you may not do
- Post anything unlawful, fraudulent, deceptive, threatening, harassing, hateful, sexually explicit, or invasive of someone else's privacy.
- List stolen goods, counterfeits, weapons, drugs, or anything you may not legally sell.
- Attempt a scam of any kind, including bait-and-switch listings, fake payment confirmations, overpayment schemes, or moving a conversation off the Service to avoid accountability.
- Impersonate anyone, or create an account on behalf of someone else.
- Spam, advertise unrelated goods or services, or contact users for anything other than the listing at hand.
- Scrape, crawl, or bulk-download content except as permitted by our robots.txt, or use the Service to build a competing dataset.
- Probe or interfere with the security of the Service, access data you are not authorized to access, or attempt to circumvent any limit or security rule.
- Use the Service if you are under 18, or have been suspended.
Your content stays yours
You keep ownership of the photos and text you post. So that we can actually run the Service, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, resize, and display that content in the Service and in pages and listings that search engines index, and to show it in promotional material for the Service. This license ends when you delete the content or your account, except for copies already made by search engines or other third parties, which are outside our control.
Moderation, reporting, and blocking
You can report a listing, and you can block another user, which removes their listings from your view and stops them from contacting you. We review reports and may remove any listing or content, or suspend or terminate any account, at our discretion and without notice — including for anything we judge unsafe, deceptive, or contrary to these terms. We are not obligated to monitor content, and our failure to act on something is not a waiver of our right to act later.
Meeting people safely
Meeting a stranger to inspect or hand over a bike carries real risk, and it is your responsibility to manage it. Meet in a public place in daylight, bring someone with you, verify the bike and its serial number before paying, and be wary of anyone who pressures you to pay before meeting or to use an unusual payment method. We provide no safety guarantee of any kind.
Third-party services
The Service runs on third-party infrastructure, and the website shows third-party advertising. Those services have their own terms and privacy practices, described in our Privacy Policy. We are not responsible for third-party content, including the advertising shown on the website.
The Service is provided as is
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or that any listing, user, or bike is as represented. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this may not apply to you.
Limits on our liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, personal injury, or property damage, arising out of or relating to your use of the Service — and in particular arising out of any transaction, communication, or meeting between you and another user.
Our total liability for any claim relating to the Service will not exceed one hundred US dollars ($100). These limits apply even if we have been advised of the possibility of such damages, and even if a remedy fails of its essential purpose.
Disputes between users
If you have a dispute with another user, you pursue it directly with them. You release us from any claim, demand, or damages of every kind arising out of or connected with such a dispute, or with the item or conduct at issue in it.
Indemnification
You agree to indemnify and hold us harmless from any claim, loss, liability, or expense, including reasonable attorney fees, arising out of your use of the Service, your content, your transactions with other users, or your breach of these terms.
Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access at any time, with or without cause. The sections on content licensing, disclaimers, liability limits, release, indemnification, and governing law survive termination.
Governing law and disputes
These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Before filing anything, please email us and give us thirty days to try to resolve the issue informally — most problems are settled that way. If that fails, you and we agree that any dispute will be brought exclusively in the state or federal courts located in California, and we each consent to the jurisdiction of those courts. Nothing here prevents either of us from bringing a claim in small claims court.
Terms that apply to the iOS app
These terms apply to your use of the eBikeTrader iOS app, and the following apply specifically to the version obtained through Apple's App Store:
- This agreement is between you and us only, not with Apple. Apple is not responsible for the app or its content.
- Your license to use the app is a non-transferable license to use it on Apple-branded devices you own or control, as permitted by the Usage Rules in the App Store Terms of Service.
- Apple has no obligation to provide any maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund your purchase price, if any. Apple has no other warranty obligation with respect to the app.
- Apple is not responsible for addressing any claim by you or a third party relating to the app, including product liability claims, claims that the app fails to conform to a legal requirement, and claims arising under consumer protection or privacy law.
- If a third party claims the app infringes their intellectual property, Apple is not responsible for the investigation, defense, settlement, or discharge of that claim.
- You represent that you are not located in a country subject to a US Government embargo or designated as a terrorist-supporting country, and that you are not on any US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Changes to these terms
We may update these terms. If a change is significant we will give notice in the app or on the site before it takes effect, and the date at the top will change. Continuing to use the Service after that means you accept the updated terms.
